The defendant was Priscilla Barnes. She was a hostess at an LA nightclub. Dunas, a freelance photographer (independent contractor), approached her asking her to pose nude and sell those nudes to Penthouse magazine. Barnes agreed to pose nude with the condition on not using her real name. Dunas agreed and added the term AKA (also known as) on the contract so the photographs would not be published using her real name but a pseudonym. Penthouse then proceeded to publish the photos using a pseudonym in 1976. Years later, Barnes became a notorious TV broadcaster in the LA area. In 1983, Penthouse informed Barnes they intended to republish her nude photograph using her real name. She threatened to sue, claiming that Dunas had implied agency to write the term AKA and that Penthouse magazine was then bound by Dunas representations and actions.
